ARTICLE 1: THE AE JEWELRY CONFIDENTIALITY POLICY

ARTICLE 3: INTELLECTUAL PROPERTY RIGHTS

The elements of this Site are protected by French and international legislation on copyright and intellectual property. The intellectual property rights to the elements of this Site, in particular the brands, models, logos and other distinctive signs, are the exclusive property of AE JEWELRY. Consequently, any partial or total reproduction of the elements of this Site is strictly prohibited without the prior written authorization of AE JEWELRY. The reproduction of certain elements of the Site is only authorized for the exclusive purposes of information for personal and private use, all reproductions or all uses of copies made for other purposes being expressly prohibited.

The “AE JEWELRY” brand, as well as all figurative or non-figurative brands and more generally all other brands, illustrations, images and logos appearing on AE JEWELRY articles, their accessories or their packaging, whether registered or not, are and will remain the exclusive property of AE JEWELRY. Any total or partial reproduction, modification or use of these brands, illustrations, images and logos, for any reason and on any medium whatsoever, without the express prior agreement of AE JEWELRY, is strictly prohibited. The same applies to any combination or conjunction with any other brand, symbol, logo and more generally any distinctive sign intended to form a composite logo. The same will apply to all copyrights, designs and models, patents which are the property of AE JEWELRY.

The use of all or part of the Site, in particular by downloading, reproduction, transmission or representation for purposes other than for personal and private use for non-commercial purposes is strictly prohibited. Violation of these provisions exposes its author to the sanctions provided for by the Intellectual Property Code, in particular, copyright counterfeiting (article L.335-1 et seq.), trademark law (article L. .716-1 et seq.) and by the Civil Code in matters of civil liability (articles 1382 et seq.).

ARTICLE 4: LINKS

AE JEWELRY is in no way responsible for hypertext links established from the Site and referring to other Internet sites.

ARTICLE 6: LIMITATION OF LIABILITY

Subject to the provisions specific to online sales and consumer law, AE JEWELRY cannot be held responsible for any direct or indirect damage which could result from the use of the Site, including inaccessibility, loss of data, deterioration, destruction or viruses which could affect users’ computer equipment and/or the presence of viruses on the Site. The user declares in this respect to accept the characteristics and limits of the Internet.

AE JEWELRY does not guarantee that the content of the Site is suitable for all countries in the world or available for use in all countries. Users must ensure compliance with the regulations applicable in their country, it being understood that access to the content of the Site may possibly be considered illegal for certain people or in certain countries. AE JEWELRY’s waiver of asserting a violation of one of the provisions of the Conditions cannot be interpreted as a waiver of asserting the violation of another provision of said General Conditions of Use.

This limitation of liability applies to the fullest extent permitted by law.

ARTICLE 7: MAINTENANCE, AVAILABILITY

AE JEWELRY will use its best efforts to maintain a reasonable level of operation and availability of the Site. AE JEWELRY reserves the right at any time, without notice, to limit access to the Site and its use by the user in order to carry out maintenance operations or make modifications. AE JEWELRY cannot be held responsible in the event of interruption of access due to these maintenance or update operations.

ARTICLE 8: APPLICABLE LAW – DISPUTES

These General Conditions of Use are governed by French law.

In the event of a dispute relating to the application and/or interpretation of these General Conditions of Use, the User has the possibility of resorting to a conventional mediation procedure or any other alternative dispute resolution procedure. Any so-called consumer dispute or litigation may be the subject of an amicable settlement by mediation with the CMAP – Paris Mediation and Arbitration Center. To submit a dispute to the mediator, the Buyer can (i) complete the form on the CMAP website: www.cmap.fr tab “you are: a consumer” (ii) send their request by simple or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to [email protected]. Whatever the means used to enter the CMAP, the User’s request must contain the following elements to be processed quickly: their postal, email and telephone contact details as well as the full name and address of AE JEWELRY, a brief statement of the facts , and proof of prior steps taken with AE JEWELRY.

The User remains free to accept or refuse recourse to mediation and, in the event of recourse to mediation, each party is free to

 accept or refuse the solution proposed by the mediator.

In the absence of an amicable solution or recourse to mediation, all disputes to which the General Conditions of Use could give rise will be submitted to the competent court of the User’s domicile.

The fact that one of the Parties does not rely on the other Party for a breach of any of its obligations referred to in these General Conditions of Use cannot be interpreted for the future. as a waiver of the obligation in question.
